At Climentum Capital Management ApS (further on referred to as “Climentum VC”), accessible from www.climentum.com, one of our main priorities is the privacy of our visitors. This Privacy & Cookie Policy (further on referred to as the “Policy”) contains types of information that are collected and recorded by Climentum VC and how we use it. The Policy applies only to our online activities and is valid for visitors to our website with regards to the information that they shared and/or collected in Climentum VC. The Policy is not applicable to any information collected offline or via channels other than this website. 

Climentum VC is the data controller and processes your personal data in order to operate and optimise the website and to send you the newsletter that you have subscribed for.

Categories of personal data and purposes of processing data

In section, we explain which personal data we collect and process for which purposes. We also explain on which legal basis we do so, and we describe for how long we process the personal data.

  • We Improve, personalize, and expand our website

  • We collect and process your name, e-mail address and consent for our provision of news and marketing materials to you.

  • We process the personal data to be able to make available to you and to optimise the functionalities on our website and for statistical purposes, and in order to distribute our newsletters to you for marketing purposes.

  • The website session cookies contain IP address, operating system, language setting, browser type, equipment type, MAC number (depending on equipment), etc.

When you submit your pitch deck or other investment opportunity related documents either through our website or by email at hello@climentum.com, we receive various information about you and possibly about your associates or employees. If your pitch deck contains personal information concerning others than yourself, you guarantee that these persons have agreed to the transfer of their personal data and that they have received the information submitted in this Policy. 

Submitting your personal data to us is voluntary, but the consequence of not submitting your personal data may be that we cannot consider your pitch deck for funding or enter into any agreement with you.

If you are, or if you represent, one of our suppliers, we process your contact information in order to manage our contractual relationship with you or the service provider that you represent.

The legal basis for the collection and processing of the personal data

The legal basis for collecting and processing data about visitors to the website is our legitimate interests in delivering and optimising the website, cf. article 6(1)(f) of the General Data Protection Regulation (“GDPR”)

The legal basis for our collection and processing of the personal data in order to distribute the newsletter to you and make the functionalities available to you is your consent, cf. article 6(1)(a) of the EU General Data Protection Regulation.

The legal basis for our collection and processing of the personal data for statistical purpose is our legitimate interest in analysing and reporting on our newsletter service, cf. article 6(1)(f) of the EU General Data Protection Regulation.

When we collect personal data directly from you for marketing purposes, you provide the personal data voluntarily. You are not obliged to provide the information to us. The consequences of not providing the personal data are that you cannot receive any of our newsletters.

You have the right to withdraw your consent. If you withdraw the consent, this will not affect the lawfulness of the processing prior to the withdrawal. Please contact us by using the contact details below if you wish to exercise this right.

Transfer of personal data

We may transfer personal data to third parties, such as tax authorities or other public institutions, if it is necessary for us to comply with a legal obligation to which we are subject, pursuant to GDPR article 6, para. 1 (c).

Further, based on a legitimate interest, pursuant to GDPR article 6, para. 1 (f), we may transfer your personal data to our technical service providers and system suppliers under processor agreements in order to secure, access, and back-up your personal data. We might also share your pitch deck with other potential investors or members of our byFounders Collective in order to optimise the funding op-portunity for your pitch.  

We only transfer your personal data to data importers outside the EU in compliance with the standard data protection clauses adopted by the European Commission providing the appropriate safeguards. You can obtain a copy of the provided safeguards by contacting us at hello@climentum.com.

We have taken appropriate technical and organizational measures to protect against unauthorized access to, loss or destruction of data for which we are responsible. We develop our security policies and procedures on a regular basis to ensure that our systems are secure and protected. Only persons with a legitimate need for processing personal data for the above-mentioned purposes have access to such data.

Retention period

We retain your personal data as long as we have a relevant legal interest therein.

If we have decided to invest in your company, we will retain your personal information for 5 years after the end of the retention period in which the company no longer exists in our start-up management system, if it is necessary for us to comply with a legal obligation to which we are subject, pursuant to GDPR article 6, para. 1 (c) - unless we asses that it is necessary to keep the data for longer.

However, if we have decided not to invest in your company, we will retain your pitch deck and contact information in our CRM system until the end of the active investment period in which that decision has been made. We retain this information as supporting material because it is necessary for the legitimate interest pursued by us to follow the positive developments of your company during a potential later round of fundraising, pursuant to GDPR article 6, para. 1 (f). If you find that this legitimate interest of ours is overridden by your interests not to have this information retained by us, you are free to exer-cise your right to have your personal data deleted or the processing thereof limited.

If you are, or if you represent, one of our suppliers, we will retain your contact information for 5 years after the end of the retention period in which the contractual relationship is terminated.

Your rights

Subject to the conditions set out in the applicable data protection legislation (GDPR), you enjoy the following rights:

  • The right to request access to copies of your personal data

  • The right to rectification – You have the right to request that we correct any information you believe is inaccurate. You also have the right to request that we complete the information you believe is incomplete.

  • The right to erasure – You have the right to request that we erase your personal data, under certain conditions.

  • The right to restrict processing – You have the right to request that we restrict the processing of your personal data, under certain conditions.

  • The right to object to processing – You have the right to object to our processing of your personal data, under certain conditions.

  • The right to data portability – You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.

  • If you make a request, we have one month to respond to you. If you would like to exercise any of these rights, please contact us.

  • Legitimate interest: You have the right to object, on grounds relating to your particular situation, at any time to processing of personal information which is based on article 6(1)(f) of the EU General Data Protection Regulation. If you object, we must no longer process the personal data unless we demonstrate compelling legitimate grounds for the processing, which override your interests, rights and freedoms or if processing is necessary for the establishment, exercise or defence of legal claims.

  • Direct marketing purposes: As your personal data is processed for direct marketing purposes, you have the right to object to processing for such purposes. If you object to the processing, we will no longer process your personal data for that purpose.

If any processing of personal data is based on your consent, you also have the right to withdraw your consent at any time. If you withdraw such consent, this will not affect the lawfulness of the processing prior to the withdrawal.

Log files

Climentum VC follows a standard procedure of using log files. These files log visitors when they visit websites. All hosting companies do this as part of hosting services' analytics. The information collected by log files includes internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any information that is personally identifiable. The purpose of the information is for analyzing trends, administering the site, tracking users' movement on the website, and gathering demographic information.
